Terms of Service

These Terms of Service ("Terms") are an agreement between you and GB Projects Inc. d/b/a Groovebook ("GrooveBook," "we," "us") governing your use of the GrooveBook app and website (the "Service"). By creating an account or using the Service, you agree to these Terms.

The Service

GrooveBook is a photobook subscription. Each month, you select 31 photos from your device in the app, and we print them into a photobook and mail it to your shipping address. If you don't select photos in a given month, no book is produced for that month; your subscription continues unless you cancel.

Eligibility and your account

You must be at least 18 years old to create an account and subscribe. You're responsible for keeping your account credentials secure, for the accuracy of your shipping address, and for all activity under your account. Books shipped to the address on file at the time of printing are considered delivered as ordered.

Subscription and billing

GrooveBook is a monthly subscription that renews automatically each month until you cancel. You can subscribe either through the Apple App Store or Google Play, or directly through our website with a credit or debit card. If you subscribe through Apple or Google, your billing, renewal, and cancellation are managed through your App Store or Google Play account settings, and their terms and refund policies apply to those charges. If you subscribe directly through our website, you can cancel anytime in your account settings; cancellation takes effect at the end of your current billing period, and you won't be charged again. We'll give you advance notice before any price change takes effect, and you can cancel before the new price applies.

Promo codes

Free-book promo codes entitle you to one free photobook. Codes are limited to one per customer unless we say otherwise, have no cash value, can't be exchanged or resold, and may require a valid account to redeem. We may set an expiration date on codes and may revoke codes that are counterfeit, resold, or obtained fraudulently.

Shipping

We currently ship within the United States. Shipping is included in your subscription price. Delivery times are estimates and can vary with carrier conditions; a delayed delivery is not grounds for a refund, but if a book is lost in transit, contact us and we'll make it right.

Refunds and reprints

Because each photobook is custom-printed with your photos, all sales are generally final. That said, we stand behind our printing: if your book arrives damaged, misprinted, or defective, email us at noah@groovebook.app within 30 days of delivery and we'll review it case by case and reprint the book or refund that month's charge. For subscriptions purchased through the App Store or Google Play, refunds are handled by Apple or Google under their policies, though we'll still gladly reprint defective books.

Your content

You own your photos. By uploading them, you grant us a limited license to store, process, print, and ship them solely to provide the Service — nothing more. You're responsible for making sure you have the rights to the photos you upload. You may not upload content that is illegal, that infringes someone else's rights, or that depicts the sexual exploitation of minors; we will remove such content, terminate the account, and report it to authorities where required by law.

Acceptable use

You agree not to misuse the Service — including attempting to access others' accounts or data, interfering with the Service's operation, reverse-engineering the app, or using the Service to violate any law. We may suspend or terminate accounts that violate these Terms.

Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service, in which case we'll refund any prepaid amounts for books not yet produced.

Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied. Colors and print quality may vary slightly from what appears on your screen. To the maximum extent permitted by law, GrooveBook's total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, or consequential damages. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in California.

Changes to these Terms

If we make material changes to these Terms, we'll notify you by email or in the app before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
